  1. Preamble
  2. The use of this Website, including web crawling, caching or any other use of services offered through it, is conditioned upon the unreserved acceptance of the Terms of Use (ToU) described henceforth and is construed as acceptance of these Terms of Use.

  4. The Institution is the Acropolis Restoration Service.

    Content is all data, software, databases, metadata as well as any other intellectual work that could be the subject of copyright according to Law No. 2121/1993, as applicable, regardless of whether the protection period has lapsed or the use falls under the copyright exceptions and which is accessible from the website of the Institution’s Website.

    Use is all kinds of accessing the Institutional Website.

    User is anyone using the Institutional Website.

    Registered User is any user who registers for the services offered by the Institution through the Website and consents for the processing of his/her personal data exclusively for the offering of value added services.

    Services are all processing functions based on digital technologies serving user needs

  6. Use of this Website is allowed for legitimate purposes only, in accordance with these Terms of Use and in a way that does not restrict or limit its use by third parties. The User's actions or omissions must not cause damage or malfunction to the Website or have any negative effect or risk to the regular provision of the Website services offered to its users.

  7. Intellectual Property Rights and Licensing Issues
  8. All content for which the Institution has the necessary rights or licences, unless explicitly stated otherwise, for instance, where third party rights subsist, is offered through the Website services exclusively under the Creative Commons licences. More specifically:

    (a) In accordance to the terms and conditions of Creative Commons Attribution ShareAlike 4.0 Greece (CC BY SA v.4.0 GR)

    (b) In accordance to the terms and conditions of any other Creative Commons licence, version 4.0 or subsequent that belongs to Free Cultural Works licences, i.e.:

    (c) In accordance to the terms and conditions of any license following the definitions of the Free Software Foundation and the Open Source Initiative on free open licences.

    The software used for the development and operation of the Website is Free/ Open Source Software and is made available through licences that comply with the definitions of the Free Software Foundation and the Open Source Initiative.

    The specific licence under which content or software is made available through the Website is explicitly specified as meta-data that are made available with the content or the software.

    The Website content or software may be made available through Graphic User Interface that allows the user to view, edit and download it or through web-services and Open Application Programming Interfaces to which access is allowed in accordance with these Terms of Use in order to download data or meta-data in accordance with the licences specified above.

    Any other work protected under intellectual property law which is licensed using licences different from those above mentioned must be expressly and specifically be identified as such.

  9. Fair Use Licence
  10. Preamble

    The content, as defined below, is provided under the terms of this Fair Use License (hereinafter, the "License") in order to facilitate its quick and easy use under the terms of the said Fair Use License.

    Definitions:

    Licensor: the information provider who has the necessary rights and authority, if required by law, to provide the relevant content.

    Metadata: information describing datasets and data services and making the discovery, recording and use, possible.

    Licensor: the natural or legal entity providing the Content under the terms of the present license

    Use: any act falling under the economic or moral rights of the copyright holder or related- rights holder or the sui-generis database creator.

    Use of the content under the terms of the present license

    The use of the content, namely of any work protected under copyright provisions, related rights and sui generis database rights, is permitted only under the terms of the present license. The use of the content by anyone and in any manner or medium, constitutes acceptance of the terms of use specified in this license.

    The Licensor provides anyone making use of this content with a worldwide, non-exclusive, free for the entire duration of the rights ownership period, license, provided that the terms specified herein are abided by.

    This license does not limit the scope of exceptions to the copyright, related rights or sui generis database rights as well as any other right on this content which might be held by the licensee, due to specific legal provisions.

    With this license:

    If one were to proceed in any of the above permissible acts, he/she should:

    (a) Indicate the source from which the information originated with reference to the Author or the licensor or the Institution, as specified in the content availability location and where possible by providing a hyperlink to the fixed point of license deposition.

    If the Licensor does not specify the manner by which he/she wishes the reference to him/her, the Author or the Institution, is to be made

    If the User makes use of content deriving from more than one licensors and the reference as above defined is not practical, the following reference could be used:

    (c) Ensure that other users of the content are not misled and neither is confusion created in relation to the actual content or its source.

    (d) Ensure that use of the content does not violate the legal framework with regard to personal data protection, confidentiality clauses or any other relevant legislation.

    The above constitute essential terms of the present license and their violation results in the immediate revocation of the present license.

    The present license does not apply to the use of:

    The licensor is liable in relation to the content supplied only with regard to the extent determined by the relevant legislation and does not guarantee its continuous supply.

    Jurisdiction and Competent Courts

    This license shall be governed by the law of the registered address of the licensor or the Institution, unless otherwise provided by law. The courts of the registered address of the Information Provider or the Institution are the ones held competent.

    Future versions

    This is version 1.0 of the Fair Use License. If subsequent versions are issued, the licensor may re-license content under the new version, or continue to license under the present version. The content use is regulated by the specific version of the license under which it is provided to the user.

  11. Access to and Reuse of Knowledge Policy

Consistent with its core mission to enrich and expand the Commons, the Institution is committed in using in all its Web Sites Free/ Open Technologies/ Source Code/ Data and Standards and to offer the entirety of its content (including both data and metadata) with licences that follow the Open Data and Free Cultural Works Definitions through Free/ Open Web Services.

    This means that all the layers of the service stack that are offered through the Institution's Website follow common principles of Open/ Free use and re-use. More specifically, where no third parties rights subsist which may not have been cleared:

    (a) Free/ Open standards are used

    (b) Free/ Open formats are used

    (c) Free/ Open Source Software is used

    (d) All Institution's web-sites are open access web sites

    (e) All content made available conform to the Free Cultural Works Definition

    (f) All data made available conform to the Open Data Definition

    (g) All services offered through the Institution's web-sites conform to the Open Service Definition

  13. Personal Data Policy
  14. Τhe Institution may collect and process personal data of its users exclusively in order to be able to offer its Website services to users.

    In any case, all personal data processing:

    In cases in which a user wishes to have access to the Services of the Website and offer to their continuous enhancement, it is necessary for him/her to give his/her personal data through the Website personal data collection forms. The Institution may use the user's personal data for promotional purposes or in order to send email messages or post news and announcements.

    The Institution does not transfer or make its users' personal data public or reveal it to third parties, unless the law stipulates the opposite or if it is under a contractual obligation to do so or such action is otherwise necessary for the operation of the Website and the performance of its key functions.

    The Institution may process personal data that may have been collected, in whole or in part, in order to improve its services or for statistical analysis reasons. The user may contact the administrator of the Website in order to ascertain the existence of any file containing his/her personal data, to change, update, correct or delete it.

    During the use of the Website, the Institution may collect personal and non-personal data that can identify the Website users, through the use of technologies such as cookies, IP protocol monitoring and other technologies that monitor the communication of the of the web-browser with the server. A cookie, also known as an HTTP cookie, web cookie, or browser cookie, is usually a small piece of data, sent from a website and stored in a user's web browser while the user is browsing the website. They are used to facilitate the user access regarding specific services or web- pages of the Website for statistical purposes and in order to determine which web locations are more useful or popular.

    Non-personal data may include the type of the web-browser, the type of the computer or smart device that the user uses to access the web-site, the operating system, the Internet Service Provider and other similar information. The user of the Website may adjust her web-browser in such a manner that it informs him/her about the use of cookies in specific services or does not allow the storage of cookies at all. In the case in which the user does not wish to accept cookies, it is possible that he/she will not be able to use all the services offered by the Website. All personal data collected by the Institution either through forms that users fill in or through the use of the Website itself, takes place in accordance with the EU Directives 95/46/EC and 2002/58/ EC respectively.

  15. Fair Terms of Use Policy
  16. The Institution is committed to openness and transparency and aims at protecting the interests of the user. Bearing in mind that commitment, it will only use fair terms and notify the user for any change of the terms of use of its Website and services.

  17. Notice and Take Down policy
  18. If a rights holder is concerned that s/he has identified material, on the Institution’s Website which is not covered by a limitation or exception under Greek copyright law and for which s/he has not given permission or granted a licence, such rights holder is asked to contact the Institution through its Helpdesk at [email protected], in writing, stating the following:

    1. His/Her contact details;
    2. The full bibliographic details of the material at question or if they are unavailable the reference information of the data;
    3. The exact and full URL where s/he found the material (ex. the URL of the entry);
    4. Proof that s/he is the rights holder and a statement that, under penalty of perjury, s/he is the rights holder or an authorised representative.

    Upon receipt of notification the ‘Notice and Takedown’ procedure is then invoked as follows:

    1. The Institution will acknowledge receipt of the complaint by email or letter and will make an initial assessment of the validity and plausibility of the complaint.
    2. Upon receipt of a valid complaint, the material at question will be temporarily removed from the Institution ' s Website pending an agreed solution.
    3. The complainant and the Institution or any other entity which deposited the material will resolve the issue swiftly and amicably and to the satisfaction of both parties, with the following possible outcomes:
      1. The material at question is replaced on the Institution' s inventory unchanged.
      2. The material at question is permanently removed from the Institution's Website.
      3. The material at question is permanently removed from the Institution' s inventory.
    4. If the Institution and the complainant are unable to agree on a solution, the infringing material will remain unavailable through the Institution' s Website until a time when a resolution has been reached.

  19. Disclaimer and Limitation on Liability
  20. The Institution offers the content (ex. Information, names, photos, depictions, data etc.) and services offered through the Website ,AS-IS. Under no circumstances does the Institution bear responsibility for any legal, civil or criminal action and any potential damages (compensatory, loss etc.) of the User deriving from this Website.

    The Website may contain references (links) to third party website with the sole purpose of informing the user. The referral links belonging to third party websites do not constitute an adoption of views and actions of these parties, neither do they constitute an endorsement of the content they express, publish or post. The third party- operators of the websites and responsibilities under law- are the ones solely responsible for the content of their websites and for any damage that may arise from their use, when the User accesses them through the Website. The User accepts, by visiting the website of third parties, that he/she leaves the Website and is subject to other conditions of use.

    The Institution shall make every possible effort to ensure the good functioning of the network, although it cannot warrant that the function of servers will be uninterrupted, free of errors, viruses, malware of other similar elements.

    The institution shall under no circumstances be held liable for any damage suffered by the user of the services, choices and content of the Website. It also does not guarantee that any website associated with this Website or the servers through which any service is made available to the user/ visitor does not contain “viruses” or other malicious software, as it does not warrant the accuracy, completeness or the availability of content, web-pages, services, choices or the results of their use.

  21. Choice of Law and Courts, Duration, Amendments
  22. The Terms of Use of this Website as well as any future amendment are governed and supplemented by Greek and EU Law and the relevant international treaties. The Greek Courts are hereby defined as those competent to hear any case arising from any differences with regard to the present. If any provision of these Terms of Use is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of these Terms and without further action by the parties, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

    These Terms of Use constitute the entire agreement between the Institution and the User of its Website and services and is binding only between them. No modification of these terms of use shall be taken into account and constitute part of this agreement unless expressed in writing and incorporated in these Terms of Use. Unless agreed otherwise, the above terms and conditions shall be rendered immediately enforceable upon their publication on the Website, as a whole.

    The Institution, unilaterally reserves the right to modify, amend and alter the content or services of the Website and its terms of use, whenever it deems necessary, with the obligation of prior notification of the registered members who have given the permission to the Institution to communicate with them, for this purpose. Otherwise, communication takes place via announcement on the Website and in accordance with applicable law.
